论民事诉讼中司法鉴定公信力的提升与完善

摘 要: 司法鉴定作为我国的一项诉讼证明活动,具有科学性、法律性、中立性和客观性的基本属性,鉴定意见在民事诉讼活动中的证据作用愈发显现。随着我国司法鉴定行业的迅速发展,目前我国司法实践中存在的诸如缺乏对司法鉴定意见的质证手段、重复鉴定导致法院采信难、司法鉴定机构及从业人员良莠不齐等问题,使得鉴定意见的科学性和法律性受到一定程度的影响,进而损害了司法鉴定的公信力。提升司法鉴定的公信力,关键在于加强民事诉讼活动中鉴定意见的证明力,以此提高鉴定意见的质量,有必要从司法行政部门和人民法院的角度出发,确立若干制度和规范以提升与完善我国司法鉴定的公信力。

The Improvement and Perfection of Credibility of Judicial Appraisal in Civil Litigation

Abstract: Forensic appraisal as an activity of proving in litigation has the basic attributes of scientificity legality neutrality and objectivity. The evidence effect of forensic opinions in civil litigation has become increasingly evident. With the rapid development of China's forensic appraisal industry there are some problems in the judicial practice such as the lack of means of cross-examination regarding forensic appraisal opinions the difficulty in acceptance of the opinions due to repeated appraisals the unbalanced level of quality for judicial appraisers and institutions which adversely influence the scientificity and legality of forensic opinions to a certain extent thereby undermining the credibility of forensic appraisal. The key to enhancing the credibility of forensic appraisal is to enhance the quality of forensic opinions by strengthening the force of proof of forensic opinions in civil litigation. It is necessary to establish a number of institutional norms to improve and perfect the credibility of China's forensic appraisal from the perspective of judicial administrative departments and courts.

环境损害司法鉴定:制度框架、现实困境与破解思路

摘 要: 在环境司法中法律责任的性质判定和责任大小确认均有赖于环境损害司法鉴定,而科学、公正的环境损害司法鉴定需要规范的机制设计予以保障。通过对环境损害鉴定评估机构、环保法庭和环境监管机构的调研,经深入分析、研判得出,环境损害司法鉴定机制应由技术性机制、程序性机制、监管机制和保障机制构成,包括以技术规范、程序规则、资质管理和法律责任等为核心的制度设计。当前,我国的环境损害司法鉴定机制存在司法鉴定机构不足、准入标准不明、人员匮乏、技术支撑不够、监管无力、法制粗疏等困境,亟需通过制度建设予以破解,以服务于环境管理和环境司法。

Forensic Expertise of Enviromental Damage:

System Framework, Realistic Dilemma and Solution

Abstract: Judging the nature and the responsibility of environmental damage depends on forensic expertise calls for normative mechanism. By investigating some environmental damage appraisal agencies, some environment courts and environment administrations, we find that the environmental damage identification and evaluation mechanism consists of technical, procedural, regulatory and safeguards mechanisms. It includes the technical specifications, procedural rules, qualification management and legal responsibility. Now, in China, there are many dilemmas with the identification and assessment of environmental damage mechanism. These dilemmas include lacking of assessment agencies, the access standards are unknown, lacking of staff, technical support is not enough, powerless supervision and the legal system is not rigorous. In order to meet the needs of environmental management and environmental forensics, all of these dilemmas need to be resolved by creating legal system as soon as possible.

阈值及其在法医毒物学领域的应用探讨

摘 要: 阈值作为被测量物存在或不存在的界限量值,在法医毒物学领域有着重要的应用价值。国家标准《车辆驾驶人员血液、呼气酒精含量阈值与检验》和公共安全行业标准《车辆驾驶人员体内毒品含量阈值与检验》的颁布实施,在法规层面确立了阈值在法医毒物学领域的地位和作用,通过阈值规范酒驾、毒驾的司法鉴定活动,为行政执法提供技术保障。综述了法医毒物学领域涉及阈值的形式、设定、作用以及应用,并就如何使用阈值规范实验室检测进行讨论。

Discussion on Cut-off Value and Its Application in Forensic Toxicology

Abstract: Cut-off is the threshold value which defines a test result for a target compound as either positive or negative. Cut-off has important application in forensic toxicology. With the standards of Blood-breath alcohol concentration and examination for driving and Drug concentration and examination for vehicle drivers being promulgated and implemented the role of cut-off in forensic toxicology is established by law. Using cut-off values forensic service applied in drunk and drug driving can be standardized to ensure the law enforcement. In this review emphasis is put on the classes definition effect and applications of cut-off values. And the utilization of cut-off in laboratory to standardize testing is also discussed.

“纸龄”鉴别中常见禾草类纤维

和韧皮类纤维的历史性研究

摘 要: 介绍中国造纸术中大量使用的14种禾草类纤维和韧皮类纤维纸张的表观特征和纤维识别方法,并对这14种纤维在造纸术中的最早出现年代和历史性发展提供了部分史实论述。在各类纤维的史实论述中还包含了部分造纸纤维的工艺改良过程及纤维配方的组成变化情况。目的是为书画鉴定和文件检验中的“纸龄”判断提供基础数据。提供的禾草类纤维和韧皮类纤维的史实特征如果与纸张的造纸工艺特征及纸张中各种化学品的品类特征相互佐证,将为“纸龄”鉴定提供可靠的科学依据。

Historical Research on Grass and Bast Fibers in the Identification of Paper Age

Abstract: This paper introduced the apparent features and identification methods of 14 categories of grass and bast fibers which are commonly used in Chinese papermaking industry since ancient times. The appeared time and historical development of these fibers were also discussed as well as the evolution of techniques and fiber composition. These are all the basic data for the identification of paper age in painting examination and questioned document examination. If the historical characteristics of fibers are consistent with the category features of chemical substances in paper the identification of paper age will be reliable.

基于GC-MS方法的可卡因毒品中的杂质分析

摘 要: 目的 通过GC-MS49份可卡因检材进行杂质分析,对不同案件进行串并,推测可卡因生产路线。方法 10 mg可卡因检材溶解于1 mL甲醇中,2 uLGC-MS分析。比较不同批次毒品间的杂质分布,推测各批次毒品生产路线并进行关联性分析。结果 初步将49份可卡因检材分为7批,其中2批检材不含肉桂酰可卡因,推测经氧化过程处理提纯,与其余可卡因检材产地来源不同;其余5批检材均含肉桂酰可卡因,推测这5批基本产地来源一致,都采用重结晶提纯路线。结论 本方法根据可卡因杂质信息进行案件的串并,初步推测所缴获可卡因毒品的生产路线。

Analysis of Impurities in Seized Cocaine by GC/MS

AbstractObject To classify and connect different cases through analyzing the impurities in seized cocaine by GC/MS, and to deduce the production routes. Method 10 mg of cocaine was dissolved in methanol, and 2 uL of the solution was analyzed by GC/MS. The distribution of impurities between batches of drugs were compared to deduce the production routes of different batches of drugs and analyze their relevance. Results The cocaine samples were initially divided into seven batches. Two batches dont contain cinnamoylcocaine that were purified by oxidation process, indicating the different geographical origin from the rest of the drugs. Another five batches all contain cinnamoylcocaine that were purified by re-crystallization. Conclusion Based on the impurities in seized cocaine, this method successfully classified the cases, and provided the information of cocaine's production route.

环境因素对黑色中性笔墨迹中

PEG低聚物降解的影响研究

摘 要: 目的 考察光照、温度和湿度对于中性笔墨迹中PEG低聚物降解变化的影响。方法 选用PEG分布不同的6支黑色中性笔平行制样,分别放置在250 W/m2辐照强度(40 ℃)的光照环境、80 % RH25 ℃)的高湿度环境和40 ℃高温环境下老化,应用液相色谱-高分辨质谱(LC-HRMS)定期检测样品中PEG各低聚物的相对含量比值R。结果 6支中性笔墨迹中R值变化趋势相同。有光照老化条件下,PEG降解最快。在同样避光的情况下,高温环境下PEG的降解速度比高湿度环境下快。高湿度环境下PEG的降解主要是微生物引起的生物降解。结论 在实际文件保存环境中,光照和温度将是影响中性笔墨迹中PEG低聚物降解的主要因素。

Effects of Environmental Parameters on the Degradation of PEG Oligomers in Black Gel Ink Entries

Abstract Objective To investigate the effects of environmental parameters on the degradation of PEG oligomers in black gel ink entries. Method Six black gel inks with different distribution of PEG oligomers were used to draw ink entry samples. Then they were kept in three environments for artificial ageing: light exposure 250W/m2 40℃), high humidity 80% RH 25℃) and high temperature 40℃). The aged samples were analyzed at different time by LC-HRMS to calculate the relative peak intensity of PEG oligomers R. Results Six gel inks with different PEG distributions showed the same decreasing trend of R. In the ink samples that were exposed to light with the presence of air flow PEG oligomers degraded fastest. On the other hand both in dark environment the degradation rate of PEG oligomers in the high temperature environment was faster than that in the high humidity environment. For the latter the degradation of PEG oligomers was mainly caused by microorganisms. Conclusion Since a high humidity environment is rare for file preservation light and temperature will be the main factors that affect the degradation of PEG oligomers in gel ink entries.

汾城人普通话口音特征的听辨研究

摘 要: 目的 了解汾城人说普通话时在声母、韵母上表现出的方言特征,为分析说话人是否为汾城人提供借鉴。方法 通过田野调查法将普通话与汾城方言的声韵特点进行比较,通过实证观察并分析汾城人说普通话时所体现出的声韵方面的方言特征。结果 从语音方面的声韵特征能够较容易判断出普通话口音较重(三级、二级低分)的汾城人,而对于普通话口音较轻(一级或二级高分)的汾城人则仅在声母[v]、单韵母[?]、后鼻音[i??]等声韵方面具有汾城方言口音特征。结论 运用4类以上声母、6类以上韵母方面的汾城口音特征能够准确判断出普通话水平三级使用者为汾城人;运用2类以上声母、7类以上韵母方面的汾城口音特征,能判断出普通话二级使用者为汾城人;对于普通话口音较轻(一级或二级高分)汾城人的判断则需联合声调、词汇等特征来进行判断。

Study on the Characteristics of Mandarin with the Accent of Fencheng Dialect

Abstract: Objective To provide reference for forensic speaker identification of Fencheng people by the accent characteristics of initials and finals in their Mandarin. Method The characteristics of initials and finals in mandarin and Fencheng dialect were compared through fieldwork and the dialect characteristics were empirically observed and analyzed. Results It is easy to recognize the Fencheng people with heavy Fencheng dialect accent grade-three grade-two with low scores in mandarin from the phonetic features of initials and finals. However the Fencheng people with a light accent grade-one grade-two with high scores only have accent characteristics in initial[v] the simple final[?] and final with a nasal ending[i??]. Conclusion Using more than 4 aspects of initial characteristics and more than 6 aspects of final characteristics can accurately recognize the Fencheng people at grade-three of Mandarin testing. Using more than 2 aspects of initial characteristics and more than 7 aspects of final characteristics can accurately recognize the Fencheng people at grade-two of Mandarin testing. It is necessary to combine the characteristics of tone and vocabulary in judging the native Fencheng people with light accent grade-one grade-two with higher scores.

电化学腐蚀法与“502”胶显现

发射过弹壳表面手印的比较研究

摘 要: 目的 比较电化学腐蚀法和“502”胶熏显法显现发射过弹壳表面的手印效果,研究电化学腐蚀显现手印的过程对枪弹痕迹检验的影响。方法 选取同一批次生产,未经发射的647.62毫米手枪弹40枚,在其表面捺印油汗混合手印,于手印捺印1天、10天、30天后进行发射,收集发射后的弹壳,对弹壳进行电解显现潜手印的处理,再次对其表面的同一枪弹痕迹进行拍照。将显现前后的枪弹痕迹进行对比,观察电化学腐蚀法显现潜手印时对传统检验弹壳表面的枪弹痕迹的影响。结果 502”胶熏显法显现发射过弹壳表面的潜手印时无任何效果;电化学腐蚀法可以显现出发射过弹壳表面的手印,纹线较为清晰连贯,手印遗留时间距发射时间较长(8~15天)的手印,发射后潜手印的显现率较高;射击过程中形成的枪弹痕迹,形态未发生明显变化,但是会破坏火药烟晕痕迹。结论 电化学腐蚀法能够用于显现发射过弹壳表面的潜手印,显出效果较好,手印遗留时间距发射时间较长(8~15天)的手印,发射后潜手印的显现率较高;电化学腐蚀法应放在枪弹痕迹检验之后进行。

Comparative Study on Electrochemical Corrosion Method and 502 Adhesive Fuming Method

 in Developing Fingerprint on the Surface of Fired Shell

Abstract: Objective To compare the developing effects by the electrochemical corrosion method and the "502" adhesive fuming method on the surface of fired shell and the influence of electrochemical corrosion method on the examination of bullet trace. Method 40 unfired bullets 7.62mm of 64 pistol of the same batch were selected. Mixed ink and sweat fingerprints were made on the surface of the 40 bullets. The bullets were fired after 1 day 10 days and 30 days respectively. The electrochemical corrosion method and the 502 adhesive fuming method were used to develop the fingerprints. The bullet trace was examined before and after developing fingerprints to evaluate the influence. Results The 502 adhesive fuming method couldnt develop the latent fingerprints on the fired shells. In contrast the electrochemical corrosion method showed good results as the ridges of the developed fingerprints was relatively clear and coherent. The fingerprints left 8-15 days before firing had more chance to be revealed by this method. The electrochemical corrosion method didnt affect the bullet trace formed during firing but it destroyed the gunpowder smoke trace. Conclusion The electrochemical corrosion method can be used to develop latent fingerprints on the surface of the shell especially for the fingerprints left in 8-15 days. Electrochemical corrosion method should be performed after trace examination.

《司法鉴定创新技术与应用示范》研究进展

 

 

编者按: 《国家中长期科学和技术发展规划纲要(20062020年)》将公共安全作为11个“亟待科技提供支撑”的国民经济和社会发展重点领域之一。近日,司法部和科技部联合印发通知,发布了《“十三五”全国司法行政科技创新规划》,这一旨在推进司法行政改革与当代科技应用深度融合,不断提高司法行政工作智能化、现代化水平的规划,将为司法行政工作改革与发展插上一双科技的翅膀。

司法鉴定科学研究院牵头主持的“十三五”国家重点研发计划《司法鉴定创新技术研究与应用示范》项目正是在这种背景下基于国家战略需求和行业突出问题而提出的。该项目具有四个显著的特点,一是项目提出的关键技术均是当前我国司法鉴定行业迫切需要解决的核心共性问题,也是全球范围内的科学前沿问题;二是本项目搭建的科研团队联合了国内最顶级的科技人才和科研资源,充分代表了中国司法鉴定的最高水平;三是本项目采用的研究方法具有很强的创新性;四是本项目成果形成的多项新技术、新标准、新产品将通过司法鉴定科学研究院的全国司法鉴定人教育基地、全国司法鉴定标准化研制基地、全国司法鉴定能力验证基地等多个平台进行技术示范和转化推广,将有效提升我国司法鉴定的科技水平,显著提高我国司法鉴定机构解决重大、复杂、疑难问题的综合鉴定能力和服务能力。

本刊就项目下设的7个课题的研究进展分别进行综述,以期引发业内同行对热点和难点问题的专门探讨,集中智慧、凝聚共识,共同提升司法鉴定行业工作水平。

专家辅助人法律地位问题研究

摘 要: 专家辅助人是司法实务中重要的角色,现已通过立法明确建立了专家辅助人制度,并在各类诉讼中发挥着越来越重要的作用。但我国立法仅仅构建了专家辅助人制度的大体框架,在立法实践上还缺乏规范性、系统性和可操作性,要想充分发挥其应有的优势和作用,必须要进一步明确专家辅助人的法律地位。对此,在简要阐述专家辅助人概念的基础上,分析专家辅助人法律地位的立法现状和现实意义,并针对专家辅助人法律地位确定的现实困境,从明确法律资格认定、明晰权力义务和完善参诉程序设计三个方面提出完善路径,以期为相关主体提供有益借鉴与参考。

法医学司法鉴定体制的现状及改革建议

摘 要: 我国现行的法医学司法鉴定体制与当前的司法改革实践及经济社会发展存在诸多不相适应之处,其中有些问题还比较突出,有必要进行相应的改革。其中主要的问题是当前的法医学司法鉴定机构与司法鉴定人准入门槛较低,多头鉴定、重复鉴定的乱象未得到有效遏止,当事人的司法鉴定成本居高不下。建议针对性的改革措施包括:建立统一、独立、分级、分类的法医学司法鉴定机构,对现存的机构进行必要的优化组合,大幅度地减少鉴定机构的数量;严格规定鉴定的启动程序,从根本上杜绝多头鉴定和重复鉴定;改革收费制度,国家适当投资,使鉴定与收费分离;强化行政与行业监督管理,严把鉴定资质关和鉴定质量关;加强法医学司法鉴定相关立法工作,使鉴定工作有法可依。

摘 要: 涉案车辆痕迹鉴定是交通事故痕迹鉴定中最核心的内容。鉴定实践中,经常出现痕迹和造痕体痕迹对应部位在距地高度、痕迹形态、变形程度、锈蚀程度、附着物等方面存在差异的情况,容易引起争议和误判。能否正确分析判断其差异是本质差异还是非本质差异,对鉴定意见的形成有着至关重要的影响。通过对交通事故中涉案车辆痕迹形成过程和形成机理进行分析,就鉴定中一些常见差异的非本质属性进行探讨。

建设工程司法鉴定无效投诉的理性认识和改进

摘 要: 近年来,司法鉴定投诉案件屡见不鲜,而建设工程司法鉴定投诉案件亦呈现上升趋势,其中含有大量无效投诉,因此讨论建设工程司法鉴定无效投诉问题的理性认识和采取改进措施就很有必要。通过对司法鉴定投诉——有效投诉和无效投诉的阐述,介绍了司法鉴定投诉与投诉处理。列举了一些建设工程司法鉴定无效投诉的案例,对其进行了理性认识和分析,并提出了对策及改进措施,特别是指出了重视出庭效果与质量是可能避免投诉的一个重要环节,并建议要加强建设工程司法鉴定跟踪回访与评价分析。

摘 要: “一带一路”是充分依靠中国与有关国家既有的双多边机制,借助既有的行之有效的区域合作平台,积极发展与沿线国家的经济合作伙伴关系,共同打造政治互信、经济融合、文化包容的利益共同体、命运共同体和责任共同体。这对司法鉴定行业也会有一定影响。为应对由此造成的风险,司法鉴定行业应当制定行业建设规划、完善司法鉴定质量管理规范、培养复合型高端司法鉴定人才、整合高校科研院所资源等。
